Terms of Service

These Terms of Service govern your access to and use of the hosted remote server provided by Persevida SL. By authorizing an Evolution API instance connection through this service, you agree to these terms.
Who Provides It
The service is operated by Persevida SL, reachable at https://github.com/singleflo/evolution-api-mcp/issues. It is an independent project: WhatsApp and Meta are trademarks of their respective owners, Evolution API is a separate open-source project, and nothing here is affiliated with, endorsed or sponsored by Meta, WhatsApp or the Evolution API project.
Open Source Foundation
The evolution-api-mcp project and server software are open-source software licensed under the MIT License. You are free to inspect, host, modify, or run your own instance of the server, including the local variant that runs on your own machine, in accordance with the terms of the MIT License.
Provided As-Is
The hosted service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise.
To the maximum extent permitted by law, Persevida SL disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and continuous uninterrupted availability. We do not guarantee that the service will meet your specific operational requirements, that a message will be delivered, or that the service will operate error-free.
User Responsibility for Your Instance and Your Messages
You are solely responsible for:
- Owning or controlling the Evolution API server and the instance you connect, and being entitled to grant the access you grant.
- The accuracy, validity, and permissions of the Evolution URL and instance token you provide during consent.
- Following the WhatsApp Business Messaging Policy and the WhatsApp Business Platform terms that apply to your account, including obtaining opt-in before you message a person, respecting the 24-hour customer-service window and using approved message templates outside it.
- Every message sent, changed or deleted on your behalf by the AI assistant you connect. Sends are real, reach real people and cannot be recalled by this service; the recipients and the wording come from you.
- Compliance with your organization's security policies and with the privacy and data-protection laws that apply to the people you message.
- Managing access revocation when the connection is no longer required.
Operation Scope and Safeguards
Our hosted remote server acts as an operational bridge to execute the actions your AI client host requests on your Evolution instance. The consent page states which Evolution integrations this deployment connects: WhatsApp Business Platform instances, and where the page lists it, WhatsApp Web (Baileys) instances. A Baileys instance is an unofficial WhatsApp Web client; WhatsApp's own terms apply to the number you link that way, WhatsApp may restrict it, and you accept that risk when you connect one.
The hosted bridge is structured to respect the settings you chose during consent: a read-only connection refuses every tool that changes data, and only the toolsets you ticked are offered. Actions that cannot be undone from this server, namely logging the WhatsApp session out, deleting a message for everyone, leaving a group, and deleting message templates, chatbots or credentials, are never available through the hosted route, and neither are tools that take passwords, API keys or tokens as input; no setting can change this. Those exist only in a local install running on your own machine, where you as the operator grant them deliberately. You remain responsible for reviewing and controlling actions issued by connected AI assistants.
Acceptable Use
Connect only an Evolution instance you are entitled to connect. Do not use the service to send spam, unsolicited or bulk messages, or messages to people who have not opted in; to harass, threaten or deceive anyone; to monitor or surveil people without their knowledge and lawful basis; to reach an instance that is not yours; to work around the limits WhatsApp or Evolution API impose; or for anything unlawful where you are. We may refuse or end a connection that does any of these.
Suspension, Changes and Termination
The hosted service may be suspended, changed or discontinued, with notice where that is practical and without it where a security or abuse problem makes waiting worse. You may end your use at any time by disconnecting the integration, which revokes your tokens and erases the stored connection. These terms may change; the date at the top says when they last did, and continuing to use the service after a change accepts it. The software itself stays MIT-licensed and self-hostable, so no decision taken here can take the capability away from you.
Governing Law
These terms are governed by the law of the place where Persevida SL is established, and disputes belong to the courts competent there, without prejudice to the protections that mandatory consumer law may give you where you live.
Limitation of Liability
In no event shall Persevida SL or the project maintainers be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of data, loss of business revenue, suspension or loss of a WhatsApp account or phone number, or operational interruption arising out of the use or inability to use this service.
